This page (together with our Privacy and Cookie Policy) tells you information about us and the legal terms and conditions (Terms) on which we sell any of the products (Products) listed on our website (our site) to you. These Terms will apply to any contract between us for the sale of Products to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Products from our site. Please note that before placing an order you will be asked to agree to these Terms. If you refuse to accept these Terms, you will not be able to order any Products from our site. You should print a copy of these Terms or save them to your computer for future reference. We amend these Terms from time to time as set out in the following terms. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 7/27/2022. These Terms, and any Contract between us, are only in the English language.

We are 5.11 International AB, a Swedish corporation doing business as 5.11 Tactical, operating out of Sweden, and with our registered office at Geijersgatan 2B, 216 18, Limhamn (“5.11”, “we”, “us”, and “our”). We operate the website and affiliated sites such as (“Website”), and other 5.11 Tactical pages on social media platforms (such as Facebook, Twitter, and the like).

For all inquiries related to an online order, including order status, please use the contact us form. Use of Our Site:

Your use of our site is governed by these Terms of Use as well as our Privacy and Cookie Policy. Please take the time to read these, as they include important terms which apply to you. You may only purchase Products from our site if you are at least 18 years old. Individuals under the age of 18 are not eligible to use the Website unsupervised and are requested not to submit any personal information to us. If you are under the age of 18, you may only use this Website in conjunction with, and under the supervision of, your parents or guardians. These Terms and our Privacy & Cookie Policy constitute the entire agreement between you and us and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between us, whether written or oral, relating to its subject matter. You acknowledge that in entering into this Contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms or Privacy & Cookie Policy. You and we agree that neither of us shall have any claim for innocent or negligent misrepresentation based on any statement in this Contract.

User Generated Content and Product Reviews:

We at 5.11, welcome your comments and submissions regarding our company, products, Website, blog, and/or services, which might include personal information about you and your use of the Website or 5.11 products. Please review our Privacy Policy for more information.

As a condition to your submission of any comments, reviews, photos, or other material, including social media posts associated with hangtags related to 5.11 (“User-Generated Content”), you agree to grant 5.11 an irrevocable, royalty-free, worldwide, and non-exclusive license to use, reproduce, distribute, publish, display, and create derivative works of the User-Generated Content, in any media now or hereafter known. 5.11 may display your User-Generated Content for other users to see, together with your name and associated social media account profile, if applicable. 5.11 may request to use or display the User-Generated Content you post on Facebook, Twitter, Instagram, or Pinterest by sending you a direct message. By responding to our message with “#YES511,” you grant us permission to use your User-Generated Content and agree to be bound by these Terms.

You understand, agree, represent and warrant that: 1) such User-Generated Content may be used on the Website and/or other 5.11 maintained websites, marketing materials, or social media pages; 2) you are 18 years of age or older and have the full power and authority to submit the User-Generated Content and grant the licenses herein; 3) the User-Generated Content will not violate anyone else's right, including copyright, trademark, privacy or other rights; and 4) your User-Generated Content complies with all applicable laws, rules and regulations, as well as any applicable third-party agreements, including without limitation Instagram, Facebook, Twitter, Pinterest, and Vine’s Terms of Use. You may not transmit any information that is or contains threatening, libelous, defamatory, scandalous, inflammatory, pornographic, profane, or otherwise unlawful, obscene or objectionable material, as determined by, and in the sole discretion of, 5.11. You will be solely responsible for the content of any submissions you might make.

5.11 has the right to remove or refuse to post any User-Generated Content for any or no reason, in its sole discretion. 5.11 cannot review all material before it is posted on the Website, or ensure prompt removal of objectionable material after it has been posted. Accordingly, 5.11 is not responsible or liable for the content or information that others post or transmit to the Website, for any error, defamation, libel, slander, omission, falsehood, obscenity, profanity or other objectionable material contained in any such information, or for the conduct of any Website user.

How the Contract is Formed:

Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process. After you place an order, you will receive an e-mail acknowledging that your order has been received. However, please note that this does not mean that your order has been accepted. Acceptance of your order will take place as described in following clause. We will confirm the acceptance to you by sending you an e-mail that confirms that the Products have been dispatched (Shipping Confirmation). The Contract between you and us will only be formed when we send you the Shipping Confirmation. If you are a business customer and not purchasing on behalf of yourself as an individual consumer, you confirm that you have authority to bind any business on whose behalf you use our site to purchase Products.

International Pricing & Delivery

Our Website operates out of Sweden. Purchases with shipping locations outside of Sweden cannot be processed and will not be shipped.

Price of products and delivery charges

The prices of the Products will be as quoted on our site at the time you submit your order, exclusive of delivery charges. The price of a Product includes VAT (where applicable) at the applicable current rate chargeable for the time being. Our delivery charges are as advised to you during the check-out process, before you confirm your order.

Prices for our Products may change from time to time, but changes will not affect any order you have already placed. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However, our site contains a large number of Products and despite our reasonable efforts, if is always possible that some of the Products on our site may be incorrectly priced. If this occurs, please contact us at cs.ce.emea@511tactical.com and we will help you to get the discrepancy corrected.

Our Right to Vary These Terms:

We may revise these Terms as they apply to your order from time to time to reflect changes in relevant laws and regulatory requirements. Every time you order Products from us, the Terms in force at the time of your order will apply to the Contract between you and us. If we have to revise these Terms as they apply to your order, we will contact you to give you reasonable advance notice of the changes and let you know how to cancel the Contract if you are not happy with the changes. You may cancel either in respect of all the affected Products or just the Products you have yet to receive. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received, and we will arrange a full refund of the price you have paid, including any delivery charges.

Your Right of Return and Refund:

5.11 Tactical has a 45-day returns and exchanges policy. You may return your merchandise to 5.11 Tactical within 45 days from the date of purchase of your product. Refunds will be applied to original credit card used at the time of purchase. 5.11 Tactical will only honor returns on orders placed directly with 5.11 Tactical. 5.11 Tactical will not honor returns on merchandise purchased at our re-sellers retail locations. Exchange must be for the same product, or a product of the same value. In the event that the retail store where you purchased the item is no longer in business or reachable, 5.11 Tactical will only be able to exchange the item for the same item in a different color or size. Items may not be worn or washed. Shipping charges will only be covered by 5.11 Tactical in the event of a return or exchange of a defective product, or a shipping error. Products may be exchanged only if original hangtags are attached and the product has not been washed or worn. In the event that the style being returned is no longer available for exchange, a product of equal value may be substituted instead. Please be sure to follow washing and handling instructions carefully as 5.11 Tactical does not give returns or exchanges due to mis-washing of products.

Return Form

Because you are a consumer, we are under a legal duty to supply Products that are in conformity with this Contract. As a consumer, you have legal rights in relation to Products.

Our Warranty For The Products:

5.11 warrants each Product sold by 5.11 or its authorized dealers to be free of defects in materials or workmanship for as long as you own the Product. The warranty above does not apply to any defect in the Products arising from:

  • Products purchased for any reseller that is outside of our authorized 5.11 dealer network
  • Damage resulting from abuse or misuse
  • Damage resulting from extended wear and tear
  • Damage resulting from tampering or a customer modification.
  • Damage resulting from exposure to a caustic substance
  • Consequential, incidental, indirect, punitive, exemplary, and/or special damages
If you are a consumer, this warranty is in addition to, and does not affect, your legal rights in relation to Products that are faulty or not as described.

Our Liability To You As A Consumer:

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this contract. We only supply the Products for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We do not in any way exclude or limit our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any breach of the terms implied by section 12 of the UK Sale of Goods Act 1979 (title and quiet possession) or any equivalent legislation in the European Union; and
  • Defective products under the Swedish Konsumentköplagen or any equivalent legislation in the European Union.
  • Events Outside Our Control:

    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below. An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract: We will contact you as soon as reasonably possible to notify you; and Our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over. You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.

    Other Important Terms:

    We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing. However if you are a consumer and you have purchased a Product as a gift, you may transfer the benefit of our warranty to the recipient of the gift without needing to ask our consent. This Contract is between you and us. No other person shall have any rights to enforce any of its terms. However, if you are a consumer, the recipient of your gift of a Product will have the benefit of our warranty, but we and you will not need their consent to cancel or make any changes to these Terms. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

    If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

    If you are a consumer, please note that these Terms are governed by Swedish law. This means a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by Swedish law. You and we both agree to that the courts of Sweden will have non-exclusive jurisdiction. If you are a resident of a different EU state then you may also bring proceedings in that state.

    Privacy and Cookie Policy

    General:

    1. 5.11 Inc., a California corporation (the “Company”, “us”, “we”) is the data controller for the personal data collected through and processed on our European websites. However, if you wish to purchase one of our products through one of our European websites, 5.11 International AB (559189-6807) (“5.11 Sweden”) will be your contract party and therefore the data controller for subsequent processing of your personal data connected to the purchase as required by local legislation – such as bookkeeping. For processing that is necessary to confirm and complete your order, the Company will be the data controller.

    2. This notice describes how we, and 5.11 Sweden, process your personal data. You will learn about the data we collect, how we use it, your rights, and the measures we take to keep it safe. We always make sure that your data are protected in accordance with applicable legislation. By “you”, we mean:

    • Our customers, i.e., individuals who purchase products on our European websites.
    • Website visitors, i.e., individuals who visit and/or interact with us through one of our European websites.
    • Marketing recipients, i.e., individuals who receive marketing communication from us (including newsletters), participate in events or competitions.
    • Dealers, Partners and Vendors, i.e., representatives of companies which we have an existing agreement with or that we will hope to enter into an agreement with.

    The personal data we process and why

    4. To complete and deliver a purchase order

    When you visit our website, we will process your personal data to help you find your closest physical store (the store locator). If you opt to place an order for one of our products through the website, we will process additional personal data to complete your order and manage delivery of the same.

    The personal data we process include your name, contact and shipping information, information about your purchase (including size, order number, etc.) and payment information. These data are also processed to confirm your purchase and to ensure that the order is properly delivered to you. Depending on your chosen payment method, we may check your credit worthiness through a third party (see below).

    Your personal data are processed because it is necessary to enter into or fulfill our agreement with you. If you are a Dealer, Partner or Vendor we process your personal data based on ours (and your company’s) legitimate interest to enter into and maintain a business relationship. Please note that you will not be able to complete the purchase if you refuse to provide us with the data. Contact us if you want to learn more about how we have balanced our interests against yours.

    We keep your personal data as long as we have an active relationship with you and for one (1) year thereafter. Certain data we, and 5.11 Sweden, may keep for a longer period of time, to comply with legal obligations (e.g., for accounting/bookkeeping purposes).

    We may share your personal data with associated payment service providers as well as with the applicable shipping partner.

    5. To evaluate your purchasing power and decide if we will accept you purchase order

    When you make an order and opt to pay with a card, information about your order (such as name, e-mail, telephone number, ship and bill to address, card information, IP-address and device, products, price and discount as well as how you have interacted with our site) are transferred to our business partner Riskified. Riskified evaluates your purchasing power and awards your order a score. The score will decide if your order is accepted or denied. If denied, the order is detained, and you will be encouraged to contact our customer support. This will give you the opportunity to complete the basis of our decision with additional information. We will then re-evaluate the decision manually. We will not keep the score value and we will collect a new score value for each and every order subsequently made.

    We do this based on our legitimate interest to prevent fraud. However, some of the data collected and transferred to Riskified are collected through cookies or other tracking technologies. Such data will only be processed if you consent to the use of cookies.     Please contact us if you want to learn more about how we have balanced our interests against yours. Also, note that we are joint controllers, together with Riskified, for the collection and transfer of your data to Riskified for the purpose of preventing fraud. However, Riskified is the sole data controller for the processing of your data after it has been transferred to Riskified. Please find their privacy statement here https://www.riskified.com/terms.

    Please contact us if you have any questions on the collection or transfer of your data for these purposes. However, any questions on the subsequent use of your data, e.g. how it is processed to generate the score, should be directed to Riskified.

    6. Managing our customer relationship, including customer support and returns

    To manage our relationship and provide support and thereto related services (such as managing any returns or cancellations) in a satisfactory manner, we need to process your personal data. This includes your name and contact information, order information, payment information, etc.

    We do this based on our legitimate interest (in this case we think our interests are aligned) and/or because we have a legal obligation to do so (e.g., in case of returns and cancellations). Please contact us if you want to learn more about how we have balanced our interests against yours.

    We will keep your data as long as we have an active relationship, or for thirty (30) days from when you contacted us last.

    7. Marketing and competitions

    Customers, Website visitors and Marketing recipients will receive marketing communication from us throughout our entire relationship. You can also sign-up to our newsletter and receive the same information/marketing communication. For this purpose, we will process your name, age, contact information, order history and IP-address.

    If you sign-up to participate in a competition or survey on our website, social media, in our retail store or at other external events, we will process personal data (such as name, phone number, address, e-mail address and IP-address).

    We process your personal data based on our legitimate interest to market our products and brand and to fulfil any obligations toward you connected with a competition. Please contact us if you want to learn more about how we have balanced our interests against yours.

    We may share your personal data with marketing agencies and similar business partners.

    We keep your personal data as long as we have an active relationship and for one (1) year thereafter. If you have signed up to our newsletter or to receive other marketing communications, or if you have joined a competition, we will keep your personal data until you opt-out from such communication.

    8. Business and product development

    We use pseudonymised/anonymised data and/or statistics to develop our business and products, to make your experience even better. We process your personal data based on our legitimate interest to provide a high-end customer experience. Please contact us if you want to learn more about how we have balanced our interests against yours.

    Pseudonymised data will be used for these purposes during the time of our relationship and for one (1) year thereafter. After this time, the pseudonymised data will be anonymised or erased.

    Location and data sharing

    9. From time to time, we may be required to submit information to a relevant third party (including but not limited to situations where we have a legal obligation to do so). This will include group companies, service providers, legal advisors, accountants, business consultants, authorities etc. We may also share your data with buyers, or potential buyers, in case of a merger or acquisition.

    10. We will process your personal data within as well as outside of the EU/EEA (primarily the US). We will do our utmost to continuously protect your privacy and ensure the safety of your personal data. For this purpose, we will enter into the EU Commission’s Standard Contractual Clauses with any data importer as necessary, to ensure that the recipient manages your data in accordance with applicable legislation.

    Your rights

    11. Access: You have the right to know if we process personal data about you. If we do, you also have the right to receive information about the personal data we process and why we do it. You also have the right to receive a copy of all personal data we have about you. The first copy will be free of charge. If you request further copies, we may charge an administrative fee.

    12. Correction: If the data we hold about you are incorrect, you have the right to have it corrected. You also have the right to supplement incomplete information with additional information that is needed for the information to be correct. Once we have corrected your data, or it has been supplemented, we will inform those we have shared your data with about the update, provided that it is not impossible or too cumbersome. If you ask us, we will also tell you who we have shared your data with.

    If you request to have data corrected, you also have the right to request that we limit our processing during the time we investigate the matter.

    13. Deletion: In some cases, you may request to have your data deleted. If we delete data following your request, we will also inform those we have shared your data with, provided that it is not impossible or too cumbersome. If you ask us, we will also tell you who we have shared your data with.

    14. Object: You have the right to object to processing that is based on our legitimate interest. If you object to the use, we will, based on your particular situation, evaluate if our interests in using the data outweigh your interests in the data not being used for that purpose. If we are unable to provide compelling legitimate grounds that outweigh yours, we will stop using the data you object to – provided we do not have to use the data to establish, exercise or defend legal claims. If you object to the use, you also have the right to request that we restrict our use during the time we investigate the matter.

    You always have the right to object to, and unsubscribe from, direct marketing.

    15. Data portability: You have the right to receive the personal data that you have provided to us in a structured, commonly used and machine-readable format, and transmit this data to another controller, provided that such portability is technically possible and that the processing is based on your consent or that it has been necessary to enter into or fulfil of our agreement

    16. Withdraw consent: If the processing of personal data is based on consent, you have the right to withdraw your consent, at any time. Such withdrawal does not affect the legality of the processing before the consent was withdrawn.

    17. Automated decision making: You have the right to not be subject to decisions based on solely automated decision making, including profiling, that may lead to legal consequences or have other similar effects.

    The right to file a complaint with the Supervisory Authority

    18. If you are not satisfied with how we process your personal data, please let us know so. You also have the right to file a complaint with the supervisory authority in the country where you reside, work or your think a breach has occurred.

    1. Pricing and Availability

    All prices are shown in Euros; taxes, shipping and handling charges are additional. All items are subject to availability and we reserve the right to impose quantity limits on any order, to reject all or part of an order and to discontinue products or services without notice, even if you have already placed your order.

    All prices are subject to change without notice and you agree that taxes may be adjusted from the amount shown on the billing screens. Several factors may cause this, such as variances between processor programs and changes in tax rates.

    Additionally, many products displayed on our websites are also available in 5.11 retail stores while supplies last, but you should not assume that what you see on the websites can always be seen in our stores. Prices displayed on the websites may vary from those in the store or from store-advertised prices.

    2. Errors

    THE LIMITATIONS SET FORTH IN THIS SECTION 11 WILL NOT LIMIT OR EXCLUDE THE 5.11 PARTIES' LIABILITY FOR PERSONAL INJURY OR PROPERTY DAMAGE CAUSED BY PRODUCTS YOU PURCHASE THROUGH THE SITES, OR FOR THE 5.11 PARTIES' GROSS NEGLIGENCE, FRAUD, INTENTIONAL, WILLFUL, MALICIOUS OR RECKLESS MISCONDUCT.
